1.1 Agreement: These Terms of Service ("Terms") constitute a legally binding agreement between Design Magic ("Company") and the individual or entity subscribing to the Company's services ("Subscriber").
1.2 Acceptance: By subscribing to or using Design Magic's services, the Subscriber acknowledges that they have read, understood, and agree to be bound by these Terms.
2.1 Scope of Services: Design Magic provides subscription-based design, marketing, strategy, and development services. Services may include, but are not limited to:
- Brand and visual design
- UI/UX and product design
- Marketing design and content
- Email newsletters and social media assets
- Website updates and improvements
- Product and brand strategy
- Light or custom development work
The exact scope of services available depends on the selected subscription plan (Starter, Plus, or Pro).
2.2 Plan-Based Service Differences:
- Starter includes foundational design, marketing support, and brand guidance.
- Plus includes full strategy, regular design work, and light development (e.g., website updates, fixes, and improvements).
- Pro includes advanced strategy, full design support, and custom development appropriate for a solo senior designer/developer.
Design Magic does not guarantee that all types of work will fit within a single update or turnaround window.
2.3 Excluded or Limited Services: Design Magic does not offer 3D modeling, 3D animation, or complex motion graphics. Limited 2D animation may be provided at the Company's discretion.
Large-scale software systems, complex backend infrastructure, third-party integrations, or highly specialized engineering tasks may require additional scoping, extended timelines, or external resources and are not guaranteed to fit within standard subscription expectations.
When applicable, Design Magic may recommend or collaborate with third-party providers with the Subscriber's approval. Any third-party costs are the responsibility of the Subscriber.
3.1 Pricing: Design Magic currently offers the following monthly subscription plans:
- Starter — $995 per month
- Plus — $2,495 per month
- Pro — $4,995 per month
All plans are billed monthly.
3.2 Payment: Subscriptions are billed at the start of each billing cycle. By subscribing, the Subscriber authorizes Design Magic to charge the payment method on file on a recurring monthly basis.
3.3 Promotional Pricing: Promotional or introductory pricing may apply for a limited billing period and will automatically revert to standard pricing unless otherwise stated.
3.4 Grandfathered Pricing: If pricing increases, active Subscribers will retain their current rate. If a subscription is paused or canceled, reactivation will be subject to current pricing.
4.1 Unlimited Requests: "Unlimited requests" refers to the number of requests a Subscriber may submit, not the number of requests worked on simultaneously.
Design Magic works on requests one at a time to maintain quality, focus, and consistent turnaround. Only one request will be actively worked on at any given time.
If a request is too large or complex to complete within a single update cycle, Design Magic will work collaboratively with the Subscriber to break the request into smaller, more manageable requests. These requests will be completed sequentially as part of the subscription.
4.2 Turnaround Times: Design Magic aims to provide updates on active requests within 1–2 business days across all subscription tiers.
Turnaround times are estimates, not guarantees, and may vary based on request complexity, clarity of requirements, current workload, and Subscriber responsiveness. Larger requests may require multiple update cycles.
4.3 Fair Use: Design Magic reserves the right to reprioritize or temporarily pause work if request volume or complexity exceeds what is reasonably deliverable within a subscription model.
Primary communication and collaboration will occur via Slack or other tools designated by Design Magic. Timely feedback and consolidated requests are required to maintain efficient progress.
6.1 Ownership: Upon full payment of all outstanding invoices, the Subscriber owns all final design assets delivered by Design Magic.
6.2 Exclusions: Design Magic retains ownership of drafts, unused concepts, internal tools, templates, processes, and methodologies.
7.1 Service Quality: Design Magic is committed to delivering high-quality, professional work aligned with the agreed direction and scope.
7.2 Revisions: Design Magic will work collaboratively with Subscribers to address reasonable revision requests. Revisions do not include unlimited revisions, repeated rework due to changing direction, or complete resets of previously approved concepts.
8.1 Subscriber Cancellation: Subscribers may pause or cancel their subscription at any time. No refunds are provided for partial billing periods unless otherwise stated in writing.
8.2 Company Termination: Design Magic reserves the right to suspend or terminate a subscription for violations of these Terms, misuse of the service, or conduct that prevents productive collaboration.
Refunds are not guaranteed and are evaluated on a case-by-case basis at the sole discretion of Design Magic.
Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas.
Design Magic reserves the right to update or modify these Terms at any time. Continued use of the services constitutes acceptance of the revised Terms.
